General information on data processing\t<\/h2>\n<h3>\n\t\t\tDescription and scope of data processing\t<\/h3>\n\t<p>We fundamentally only process the personal data of our users to the extent necessary for the provision of a functional website and our content and services. The processing of personal data of our users regularly only takes place after the users' consent. An exception applies in cases where obtaining prior consent is not possible for factual reasons and the processing of data is permitted by legal regulations.<\/p>\n<h3>\n\t\t\tLegal basis for the processing of personal data\t<\/h3>\n\t<p>Where we obtain consent from the data subjects for processing personal data, Article 6(1)(a) of the General Data Protection Regulation (GDPR) serves as the legal basis. When processing personal data that is necessary for the performance of a contract to which the data subject is party, Article 6(1)(b) of the GDPR serves as the legal basis. This also applies to processing operations that are necessary for the implementation of pre-contractual measures. Where the processing of personal data is necessary for compliance with a legal obligation to which our university is subject, Article 6(1)(c) of the GDPR serves as the legal basis.<\/p>\n<p>In cases where the processing of personal data is necessary for the vital interests of the data subjects or another natural person, Article 6(1)(d) of the GDPR serves as the legal basis. If processing is necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in our university, Article 6(1)(e) of the GDPR in conjunction with Section 3 of the NDSG serves as the legal basis.<\/p>\n<p>The processing is necessary for the purposes of the legitimate interests pursued by our university or by a third party, provided that the interests, fundamental rights and freedoms of the data subject do not override those interests, then Article 6(1)(f) GDPR serves as the legal basis for the processing, provided that the processing is not carried out in the performance of public tasks by our university (Article 6(1) second subparagraph GDPR).<\/p>\n<h3>\n\t\t\tData deletion and storage period\t<\/h3>\n\t<p>Users' personal data will be deleted or blocked as soon as the purpose of storage ceases to apply. Storage may also occur if this has been provided for by the European or national legislator in European regulations, laws or other provisions to which the controller is subject. Blocking or deletion of the data also takes place when a storage period prescribed by the aforementioned rules expires, unless the data needs to be stored further for the conclusion or fulfilment of a contract.<\/p>\n<h2>\n\t\t\tV. Provision of the website and creation of log files\t<\/h2>\n<h3>\n\t\t\tDescription and scope of data processing\t<\/h3>\n\t<p>On each call to our website, the hosting system automatically collects data and information from the computer system of the calling computer. The following data is collected:<\/p>\n<ul>\n<li>The IP address of the users<\/li>\n<li>Date and time of access<\/li>\n<li>Time difference between requesting host and web server<\/li>\n<li>Content of the request or the retrieved file<\/li>\n<li>Access status (successful submission, error, etc.)<\/li>\n<li>the amount of data transferred in bytes<\/li>\n<li>the website from which access was made (referrer URL)<\/li>\n<li>the browser used, the operating system, the user interface, the language and version of the browser software<\/li>\n<\/ul>\n<p>The data is stored in the log files of our system or the systems of our hoster. Storage of this data together with other personal data of the user does not take place.<\/p>\n<h3>\n\t\t\tLegal basis of the data processing\t<\/h3>\n\t<p>The legal basis for the temporary storage of data and log files is Article 6(1)(e) GDPR in conjunction with Section 3 of the NDSG.<\/p>\n<h3>\n\t\t\tPurpose of the data processing\t<\/h3>\n\t<p>The temporary storage of the IP address by the system is necessary to enable the delivery of the website to users' computers. For this purpose, users' IP addresses must be stored for the duration of the session.<\/p>\n<p>The storage in the log files is for the purpose of ensuring the functionality of the website, as well as for protection against attacks and to ensure the proper operation of our information technology systems. Furthermore, we use the data to optimise the website. Data will not be analysed for marketing purposes in this context.<\/p>\n<p>This also encompasses our public interest in data processing pursuant to Article 6(1)(e) GDPR in conjunction with Section 3 of the NDSG, as the provision of a functional and secure website is part of the performance of our public duties as a university.<\/p>\n<h3>\n\t\t\tRecipient\t<\/h3>\n\t<p>The log files are stored and processed on the servers of our hoster, ALL-INKL.COM \u2013 Neue Medien M\u00fcnnich, Inh. Ren\u00e9 M\u00fcnnich, Hauptstra\u00dfe 68, 02742 Friedersdorf, Germany (see section 06 \u201eHosting\u201c). Personal reference to an IP address is only established in the event of unlawful attacks or abuse of the services. Otherwise, no combination with other data takes place and no data is passed on to third parties, unless required by official or court orders.<\/p>\n<h3>\n\t\t\tDuration of storage\t<\/h3>\n\t<p>The data will be deleted as soon as it is no longer required to achieve the purpose for which it was collected. In the case of data collection for the provision of the website, this is the case when the respective session is ended (closing the browser).<\/p>\n<p>In the event of data being stored in log files, it will be, at the latest, after <strong>7 days<\/strong> deleted. Further storage is possible in individual cases, for example in the event of an attack on our information technology systems.<\/p>\n<h3>\n\t\t\tPossibility of objection and removal\t<\/h3>\n\t<p>The collection of data for the provision of the website and the storage of the data in log files is absolutely necessary for the operation of the website. Consequently, there is no possibility for the user to object.<\/p>\n<h2>\n\t\t\tVI. Use of cookies\t<\/h2>\n<h3>\n\t\t\tDescription and scope of data processing\t<\/h3>\n\t<p>Our website uses cookies. Cookies are text files that are stored in, or by, the web browser on the user\u2019s computer system. When a user visits a website, a cookie may be stored on their operating system. This cookie contains a unique string of characters that enables the browser to be uniquely identified when the website is visited again.<\/p>\n<p>We only use technically necessary cookies to make this website more user-friendly. Some elements of our website require the calling browser to be identifiable even after a page change. Cookies that are not technically necessary (e.g. for analysis or marketing purposes) are not used.<\/p>\n<p><em>The following data is stored and transmitted in the cookies:<\/em><\/p>\n<ul>\n<li>Log-in information<\/li>\n<\/ul>\n<h3>\n\t\t\tLegal basis for data processing\t<\/h3>\n\t<p>As these are exclusively technically necessary cookies, no consent is required for their storage and access to information on the user's terminal device (\u00a7 25 para. 2 no. 2 TDDDG). The legal basis for the associated processing of personal data is Art. 6 para. 1 lit. e GDPR in conjunction with \u00a7 3 NDSG.<\/p>\n<h3>\n\t\t\tPurpose of the data processing\t<\/h3>\n\t<p>The purpose of using technically necessary cookies is to make using websites easier for users. Some functions of our website cannot be offered without the use of cookies. For these, it is necessary that the browser is recognised again even after changing pages.<\/p>\n<p><em>We require cookies for the following applications:<\/em><\/p>\n<ul>\n<li>The provision of log-in protected areas<\/li>\n<li>The user data collected through technically necessary cookies are not used to create user profiles.<\/li>\n<\/ul>\n<h3>\n\t\t\tDuration of storage, possibilities of objection and elimination\t<\/h3>\n\t<p>Cookies are stored on users' computers and transmitted from there to our site. Therefore, you as a user have full control over the use of cookies. By changing the settings in your internet browser, you can deactivate or restrict the transmission of cookies. Already stored cookies can be deleted at any time. This can also be done automatically. If cookies are deactivated for our website, it may not be possible to use all functions of the website to their full extent.<\/p>\n<h2>\n\t\t\tVII. No integration of further services, tracking and analysis tools\t<\/h2>\n\t<p>Apart from the processing operations mentioned in this privacy policy, we do not integrate any further third-party services or content into our website. In particular, we do not use any tracking or analytics tools (e.g. Google Analytics, Matomo or similar), any social media plugins (e.g. from Facebook, Instagram, X\/Twitter, LinkedIn), no embedded videos (e.g. from YouTube or Vimeo), no external map data (e.g. Google Maps) and no externally integrated fonts (e.g. Google Fonts). Consequently, no data is transferred to the providers of such services.<\/p>\n<p>Should we integrate such services in the future, we will update this privacy policy accordingly and inform you separately about the respective legal basis and the scope of data processing.<\/p>\n<h2>\n\t\t\tVIII. Newsletter and associated data\t<\/h2>\n<h3>\n\t\t\tDescription and scope of data processing\t<\/h3>\n\t<p>If you wish to subscribe to the newsletter offered on the website, we require your email address and information that allows us to verify that you are the owner of the specified email address and that you agree to receive the newsletter. No other data will be collected, or only on a voluntary basis.<\/p>\n<p>We use this data exclusively for sending the requested information and do not pass it on to third parties.<\/p>\n<p>No external newsletter service is used for sending out mailings.<\/p>\n<h3>\n\t\t\tLegal basis for data processing\t<\/h3>\n\t<p>The data entered in the newsletter subscription form is processed solely on the basis of your consent (Article 6(1)(a) of the GDPR).<\/p>\n<p>You can revoke your consent to the storage of your data and your email address, and to their use for sending the.<\/p>\n<h3>\n\t\t\tPurpose of the data processing\t<\/h3>\n\t<p>The purpose of collecting the user's email address is to deliver the newsletter and to verify that the user is the owner of the stated email address and consents to receiving the newsletter.<\/p>\n<h3>\n\t\t\tDuration of storage\t<\/h3>\n\t<p>The data you have provided us for the purpose of subscribing to the newsletter will be stored by us until you unsubscribe from the newsletter, and will be deleted from the newsletter distribution list after unsubscription or if the purpose ceases to apply. We reserve the right to delete or block e-mail addresses from our newsletter distribution list at our own discretion within the scope of our legitimate interest in accordance with Art. 6 para. 1 lit. f GDPR.<\/p>\n<p>Data stored with us for other purposes will remain unaffected.<\/p>\n<h3>\n\t\t\tPossibilities of objection and removal\t<\/h3>\n\t<p>Following your removal from the newsletter distribution list, your email address may be stored by us on a blacklist if this is necessary to prevent future mailings. The data from the blacklist will only be used for this purpose and will not be merged with other data. This serves to protect both your interests and our interest in complying with legal requirements for sending newsletters (legitimate interest within the meaning of Art. 6(1)(f) GDPR). Storage on the blacklist is not time-limited. You may object to storage if your interests outweigh our legitimate interest.<\/p>\n<h2>\n\t\t\tIX. Rights of the data subject\t<\/h2>\n\t<p>If your personal data is processed, you are a data subject within the meaning of the GDPR and you have the following rights vis-\u00e0-vis the controller:<\/p>\n<h3>\n\t\t\tRight to information\t<\/h3>\n\tYou may request confirmation from the controller as to whether personal data relating to you is being processed by us.<br \/>\nIf there is such processing, you can request information from the controller about the following:\n<ul>\n<li>the purposes for which the personal data are processed;<\/li>\n<li>the categories of personal data which are processed;<\/li>\n<li>the recipients or categories of recipients to whom the personal data concerning you have been or will be disclosed;<\/li>\n<li>the planned duration of the storage of the personal data relating to you or, if specific information on this is not possible, criteria for determining the storage duration;<\/li>\n<li>the existence of a right to rectify or erase personal data concerning you, a right to have processing restricted by the controller or a right to object to such processing;<\/li>\n<li>the existence of a right of appeal to a supervisory authority;<\/li>\n<li>any available information on the origin of the data if the personal data are not collected from the data subject;<\/li>\n<li>the existence of automated decision-making, including profiling, pursuant to Article 22(1) and (4) of the GDPR and, at least in these cases, meaningful information about the logic involved and the scope and intended effects of such processing for the data subject.<\/li>\n<\/ul>\n<p>You have the right to request information on whether personal data concerning you is transferred to a third country or to an international organisation. In this context, you may request to be informed about the appropriate safeguards pursuant to Art. 46 of the GDPR in connection with the transfer.<\/p>\n<h3>\n\t\t\tRight of rectification\t<\/h3>\n\t<p>You have a right of rectification and\/or completion vis-\u00e0-vis the controller if the personal data processed concerning you are inaccurate or incomplete. The controller shall carry out the rectification without undue delay.<\/p>\n<h3>\n\t\t\tRight to restrict processing\t<\/h3>\n\t<p>You may request the restriction of the processing of personal data concerning you under the following conditions:<\/p>\n<ul>\n<li>if you contest the accuracy of the personal data concerning you for a period enabling the controller to verify the accuracy of the personal data;<\/li>\n<li>the processing is unlawful and you refuse the erasure of the personal data and instead request the restriction of the use of the personal data;<\/li>\n<li>the controller no longer needs the personal data for the purposes of processing, but you need it for the assertion, exercise or defence of legal claims, or<\/li>\n<li>if you have objected to the processing pursuant to Art. 21 (1) DSGVO and it has not yet been determined whether the legitimate grounds of the controller outweigh your grounds.<\/li>\n<\/ul>\n<p>Where the processing of personal data relating to you has been restricted, those data may be processed, with the exception of their storage, only with your consent or for the establishment, exercise or defence of legal claims or for the protection of the rights of another natural or legal person or for reasons of substantial public interest of the Union or of a Member State.<\/p>\n<p>If the restriction of processing has been restricted in accordance with the above conditions, you will be informed by the controller before the restriction is lifted.<\/p>\n<h3>\n\t\t\tRight to erasure\t<\/h3>\n<h4>\n\t\t\tObligation to delete\t<\/h4>\n\t<p>You may request the controller to erase the personal data concerning you without delay and the controller is obliged to erase this data without delay if one of the following reasons applies:<\/p>\n<ul>\n<li>The personal data concerning you are no longer necessary for the purposes for which they were collected or otherwise processed.<\/li>\n<li>You revoke your consent on which the processing was based pursuant to Art. 6 (1) a or Art. 9 (2) a DSGVO and there is no other legal basis for the processing.<\/li>\n<li>You object to the processing pursuant to Art. 21 (1) DSGVO and there are no overriding legitimate grounds for the processing, or you object to the processing pursuant to Art. 21 (2) DSGVO.<\/li>\n<li>The personal data concerning you has been processed unlawfully.<\/li>\n<li>The deletion of the personal data concerning you is necessary for compliance with a legal obligation under Union or Member State law to which the controller is subject.<\/li>\n<li>The personal data concerning you was collected in relation to information society services offered pursuant to Art. 8 (1) DSGVO.<\/li>\n<\/ul>\n<h4>\n\t\t\tInformation to third parties\t<\/h4>\n\t<p>If the controller has made the personal data concerning you public and is obliged to erase it pursuant to Article 17(1) of the GDPR, it shall take reasonable steps, including technical measures, having regard to the available technology and the cost of implementation, to inform data controllers which process the personal data that you, as the data subject, have requested that they erase all links to, or copies or replications of, that personal data.<\/p>\n<h4>\n\t\t\tExceptions\t<\/h4>\n\t<p>The right to erasure does not exist where processing is necessary:<\/p>\n<ul>\n<li>to exercise the right to freedom of expression and information;<\/li>\n<li>for compliance with a legal obligation which requires processing under Union or Member State law to which the controller is subject or for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller;<\/li>\n<li>for reasons of public interest in the area of public health pursuant to Art. 9 (2) (h) and (i) and Art. 9 (3) DSGVO;<\/li>\n<li>for archiving purposes in the public interest, scientific or historical research purposes or statistical purposes pursuant to Article 89(1) of the GDPR, where the right referred to in Section a) is likely to render impossible or seriously prejudice the achievement of the purposes of such processing, or<\/li>\n<li>for the assertion, exercise or defence of legal claims.<\/li>\n<\/ul>\n<h4>\n\t\t\tRight to information\t<\/h4>\n\t<p>If you have asserted the right to rectification, erasure or restriction of processing against the controller, the controller is obliged to communicate this rectification or erasure of the data or restriction of processing to all recipients to whom the personal data concerning you have been disclosed, unless this proves impossible or involves a disproportionate effort.<\/p>\n<p>You have the right to be informed of these recipients by the controller.<\/p>\n<h4>\n\t\t\tRight to data portability\t<\/h4>\n\t<p>You have the right to receive the personal data concerning you that you have provided to the controller in a structured, commonly used and machine-readable format. You also have the right to transmit this data to another controller without hindrance from the controller to whom the personal data has been provided, provided that<\/p>\n<ul>\n<li>the processing is based on consent pursuant to Art. 6 para. 1 lit. a DSGVO or Art. 9 para. 2 lit. a DSGVO or on a contract pursuant to Art. 6 para. 1 lit. b DSGVO and<\/li>\n<li>the processing is carried out with the aid of automated procedures.<\/li>\n<\/ul>\nIn exercising this right, you also have the right to have the personal data concerning you transferred directly from one controller to another controller, insofar as this is technically feasible. This must not affect the freedoms and rights of other persons.<br \/>\nThe right to data portability shall not apply to processing of personal data necessary for the performance of a task carried out in the public interest or in the exercise of official authority vested in the controller.\n<h4>\n\t\t\tRight of objection\t<\/h4>\n\t<p>You have the right to object at any time, on grounds relating to your particular situation, to the processing of personal data relating to you which is carried out on the basis of Article 6(1)(e) or (f) DSGVO; this also applies to profiling based on these provisions.<\/p>\n<p>The controller shall no longer process the personal data concerning you unless it can demonstrate compelling legitimate grounds for the processing which override your interests, rights and freedoms, or for the establishment, exercise or defence of legal claims.<\/p>\n<p>If the personal data concerning you is processed for the purpose of direct marketing, you have the right to object at any time to the processing of personal data concerning you for the purpose of such marketing; this also applies to profiling insofar as it is related to such direct marketing.<\/p>\n<p>If you object to processing for direct marketing purposes, the personal data concerning you will no longer be processed for these purposes.<\/p>\n<p>You have the possibility, in connection with the use of information society services, notwithstanding Directive 2002\/58\/EC, to exercise your right to object by means of automated procedures using technical specifications.<\/p>\n<h4>\n\t\t\tRight to revoke the declaration of consent under data protection law\t<\/h4>\n\t<p>You have the right to revoke your declaration of consent under data protection law at any time. The revocation of consent does not affect the lawfulness of the processing carried out on the basis of the consent until the revocation.<\/p>\n<h4>\n\t\t\tAutomated decision in individual cases including profiling\t<\/h4>\n\t<p>You have the right not to be subject to a decision based solely on automated processing, including profiling, which produces legal effects concerning you or similarly significantly affects you. This does not apply if the decision<\/p>\n<ol>\n<li>is necessary for the conclusion or performance of a contract between you and the responsible person,<\/li>\n<li>is authorised by legislation of the Union or the Member States to which the controller is subject and that legislation contains adequate measures to safeguard your rights and freedoms and your legitimate interests, or<\/li>\n<li>is done with your express consent.<\/li>\n<\/ol>\n<p>However, these decisions must not be based on special categories of personal data pursuant to Art. 9(1) of the GDPR, unless Art. 9(2)(a) or (g) of the GDPR applies and appropriate measures have been taken to protect the rights and freedoms and your legitimate interests.<\/p>\n<p>With regard to the cases referred to in (1) and (3), the controller shall take reasonable steps to safeguard the rights and freedoms of, and your legitimate interests, including at least the right to obtain the intervention of a person on the part of the controller, to express his or her point of view and to contest the decision.<\/p>\n<h4>\n\t\t\tRight to complain to a supervisory authority\t<\/h4>\n\t<p>Without prejudice to any other administrative or judicial remedy, you have the right to lodge a complaint with a supervisory authority, in particular in the Member State of your residence, place of work or the place of the alleged infringement, if you consider that the processing of personal data concerning you infringes the GDPR.<\/p>\n<p>The supervisory authority to which the complaint has been lodged shall inform the complainant of the status and outcome of the complaint, including the possibility of a judicial remedy under Article 78 GDPR.<\/p>\n<h2>\n\t\t\tX. Where appropriate consent has been requested, processing is carried out exclusively on the basis of Art. 6(1)(a) GDPR and \u00a7 25(1) TDDDG, insofar as the consent covers the storage of cookies or access to information in the user's terminal device (e.g. device fingerprinting) within the meaning of the TDDDG. Consent can be withdrawn at any time.<\/p>\n<p>Our host will only process your data to the extent necessary to fulfil its service obligations and will comply with our instructions regarding this data.<\/p>\n<h4>\n\t\t\tProcessing of orders\t<\/h4>\n\t<p>We have concluded a Data Processing Agreement (DPA) for the use of the aforementioned service.
